IMPORTANT INFORMATION: Georgia Motor Carrier Act of 2012
Effective July 1, 2012, the Georgia Motor Carrier Act of 2012 (HB 865) transferred responsibility for regulation, certification, permitting, and enforcement of laws, rules, and regulations governing household goods movers, passenger carriers (motor coaches & buses), luxury limousine carriers, and non-consensual towing operations from the Georgia Public Service Commission to the Georgia Department of Public Safety.
The Motor Carrier Compliance Division, Regulations Compliance Section, of the Georgia Department of Public Safety is responsible for the enforcement of the Rules, Regulations, and Laws governing household goods movers, passenger carriers (motor coaches & buses), luxury limousine carriers, and non-consensual towing operations. The Department is firmly committed to fair economic practices and the safe operation of motor vehicles. Under current Georgia law, motor carriers engaging in the intrastate (within Georgia) transportation of household goods and passengers are required to possess Certificates or Permits issued by the Georgia Department of Public Safety. Additionally, limousine carriers and non-consensual tow operations are also required to possess Certificates or Permits issued by the DPS.
Furthermore, drivers of luxury limousines and limousine carrier vehicles must have a ?Chauffer?s? endorsement on their driver?s license, which is issued by the Georgia Department of Driver Services (DDS).
The Georgia Department of Public Safety (DPS) is primarily a law enforcement organization, and we encourage all motor carriers and drivers to comply with the Rules and Regulations of the Department, as well as Georgia law. Those who choose to operate illegally may face both criminal and civil penalties for non-compliance.
New applicants for Certificates or Permits to transport passengers for hire, including limousine carriers, must have all of their vehicles inspected by a MCCD officer prior to such authority being issued by Department of Public Safety. This is also an annual requirement.
Existing Certificated or Permitted Carriers
(those already possessing passenger carrier or limousine carrier authority)
AFTER January 1, 2013, all motor carriers of passengers, including limousine carriers, who possess a Certificate or Permit to transport passengers issued by DPS must have their vehicles inspected annually by a MCCD officer; the purpose of these inspections is to verify the safety of the vehicle and the driver. Also, any additional vehicles added to your fleet must receive a DPS safety inspection, prior to utilizing them in passenger carrier or limousine carrier service. It is your duty as the motor carrier to schedule YOUR safety inspections with the Department by calling the Regulations Compliance Section at 404-463-7741 or 404-463-3880. Please do not call any other number to schedule these inspections; they must be scheduled through the Regulations Compliance Section. Additionally, as a service to you as a DPS customer, if you are outside of the metro Atlanta area we can arrange to inspect your vehicles at your facility.
